General aspects |
These General Terms and Conditions of Sale use a particular terminology, the most important elements of which are as follows:
Customer : web user or consumer who connects to the boutique at http://www.shop.sabatier.com with the intention of ordering one or more articles.
Hours worked : hours during which the shipping company, the company SABATIER DIAMANT, carries out its commercial activities, i.e. from Monday to Thursday from 8:00 a.m. to 6:00 p.m. (French time) and Friday from 8:00 a.m. to 4:00 p.m. (French time).
INCOTERMS : international conditions of sale which define, for each kind of sale, the obligations and rights of the buyer and the vendor
Days worked : days during which the shipping company, the company SABATIER DIAMANT, carries out its commercial activities, i.e. from Monday morning to Friday evening (i.e. excepting Saturday, Sunday and legal holidays).
Working days : days during which businesses in the shipping country or the destination company carry out their commercial activities. Working days and legal holidays may vary depending on the destination country.
1 - Scope and modifications to the General Terms and Conditions of Sale |
These General Terms and Conditions of Sale apply to all orders placed via the websites www.sabatier.com or www.shop.sabatier.com.
The company SABATIER DIAMANT reserves the right to modify these General Terms and Conditions of Sale at any time. In the event of such modification, the General Terms and Conditions of Sale in force on the day of the placement of the order shall be enforceable.
2 - Acceptance of the General Terms and Conditions of Sale |
The customer fills out the order form that is presented on the website. In order to confirm the order and initiate the sale, the customer must accept, fully and without reservation, the General Terms and Conditions of Sale. These same conditions shall be the only ones applicable to the contract thus concluded.
3 - Order and contract |
The commercial contract between the company SABATIER DIAMANT and the customer comes into existence when the order is confirmed. The order shall be deemed to have been accepted by the company SABATIER DIAMANT once the partner banking organisation has accepted the payment.
All order forms confirmed by means of the acceptance of the General Terms and Conditions of Sale and the submission of the payment data shall be deemed an irrevocable acceptance which may only be challenged within the limits set forth in these General Terms and Conditions of Sale, under the terms of the "right of withdrawal".
All commercial contracts impose obligations upon both of the contracting parties:
- the obligations of the company SABATIER DIAMANT:
Insofar as the customer's order is accepted (acceptance of the General Terms and Conditions of Sale, confirmation of the order and payment accepted by the partner banking organisation), the company SABATIER DIAMANT undertakes to deliver the products ordered to the address provided by the customer. It will provide the products ordered to the partner carrier within a period of no more than 72 hours worked after the acceptance of the order.
Whether the customer's order is accepted or refused, the customer will receive confirmation thereof by e-mail only, within 24 hours worked (office opening hours) of the order being accepted or refused.
The company SABATIER DIAMANT reserves the right to refuse an order if the products ordered are unavailable or if there is a risk that the order received or the forthcoming delivery might prove to be problematic.
- the obligations of the customer:
The customer undertakes first of all to verify that the order has been confirmed and to indicate any error there may be in the order within a period of no more than 12 hours following the placement of the order. Any complaints or claims shall be made using the e-mail address created to this effect (customer-service@sabatier.com / service-client@sabatier.com)
Furthermore, the customer undertakes to supply the company SABATIER DIAMANT with an address to which the delivery may be made during the working hours of the day (during the hours worked).
Last of all, the customer undertakes to pay the given price for the service or products provided by the company SABATIER DIAMANT. If the given price does not include shipping costs, customs and excise duties and any other import taxes that may exist in the country of delivery (paragraph 4.1), the customer undertakes to pay, upon reception of the goods, all such additional expenses to the carrier of the company SABATIER DIAMANT.
The customer must under no circumstances sell on the products it purchases via the website of the company SABATIER DIAMANT. All orders placed by a customer may only be used for his or her own personal use or for the personal use of the person on whose behalf the order was placed.
In the latter instance, the customer guarantees the acceptance of the General Terms and Conditions of Sale by the final recipient of the delivery.
4 - Price - Payment |
The overall price indicated by the company SABATIER DIAMANT on the order confirmation is the definitive price of the order.
The SABATIER DIAMANT reserves the right to modify its tariffs at any time, but naturally undertakes to apply the tariffs in force on the date of the order.
The overall price given on the order confirmation may or may not include the cost of shipping, customs and excise costs and the taxes specific to the country of import.

The export of manufactured products to Brazil is subject to customs duties and import taxes.
Regardless of the value of the order placed on the website, the customer shall bear the costs of carriage and the customs duties and taxes incurred in the country of import.
Payment of the orders shall be made in Euros and US Dollars.
Amounts given on the website in a currency other than the Euro and US Dollars are done so for purely informational purposes.
The payment of orders shall be carried out by bankcard only, by means of the server of the company SABATIER DIAMANT's banking partner (NATEXIS Banques Populaires). This is a secure payment mode, because it means that none of the customer's banking information transits via the website of the company SABATIER DIAMANT. The on-line payment may be made in complete safety, by entering the number of the bankcard, the date of expiry of the bankcard and the number of the visual cryptogram that is given on the back of the bankcard.
The payment is made secure by means of the encryption of the customer's credit card details using the 128-bit SSL (Secure Socket Layer) protocol. The details of the customer's bankcard never transit visibly on the bank's server. Under no circumstances does the company SABATIER DIAMANT have access to these details, nor are they kept on its servers. If a customer visits the boutique at shop.sabatier.com and places an order on several occasions, he or she will be obliged to fill out the bank details for the bank's server each time.
The company SABATIER DIAMANT reserves the right to refuse delivery to or to honour an order placed by a consumer with whom there exists an outstanding dispute with respect to payment.
5 - Delivery |
In France
The products shall be delivered by an express carrier (FRANCE EXPRESS) to the address given by the customer on the order confirmation.
Abroad
The products shall be delivered by express carrier (FEDEX) to the address given by the customer on the order confirmation.
- 5.2 - Delivery lead times
The products shall be delivered within a period of between one (1) and nine (9) working days as from the date of the order confirmation. The lead times given to the company SABATIER DIAMANT by its partner carrier vary according to the country.
These average lead times are given for informational purposes on the Internet site and on the order confirmation sent to the customer. The company SABATIER DIAMANT cannot be held liable for any overrun of the lead time given, and pursuant to article L.120 20-3 of the code of consumption, has a period of a maximum of 30 days from the day on which the consumer placed the order.
- 5.3 - Monitoring of deliveries
Within 24 hours worked of having placed the order, the customer will receive confirmation of the order by e-mail (paragraph 3). This e-mail contains a summary of the order as well as the number of the shipping notice, which will enable the customer to monitor the progress of the package by connecting to the website of the carrier or by clicking on the logo of the carrier that features on the pages of the website shop.sabatier.com.
6 - Reception (exceptions, return, replacement, reimbursement) |
- 6.1 - Reception of the package
The customer has undertaken to supply an address to which the delivery may be made during the working hours of the day (during the hours worked).
In the event that the recipient or any person able to take possession of the goods is absent at the time the package is delivered, the carrier will leave a non-delivery notice at the address given by the customer, in which the date and the hour of the attempted delivery will be stated.
Any shipment that remains undelivered after three attempts shall be sent back to the nearest offices of the partner carrier and an attempt to inform the recipient shall be made.
If the delivery address given by the customer is a private address ("residential" delivery), only one attempt to deliver shall be made subsequent to the initial delivery.
If the shipment is not delivered after three (3) delivery attempts (two (2) attempts in the case of a private address) or has been kept for five (5) working days after the date of its reception and of its customs clearance by customs in the country of delivery, it shall be considered to be undistributable and shall be returned to the company SABATIER DIAMANT.
The company SABATIER DIAMANT cannot be held liable for any damage incurred by the products in the event of the late collection, or non-collection, of the package by the customer.
The customer should check that the goods delivered comply with the order and are in good condition, before signing the delivery slip.
Such verification shall be deemed to have been performed once the customer, or a person duly authorised to do so by the customer, has signed the delivery slip.
All anomalies with respect to the delivery (damaged product, etc.) must be set out by the customer in the form of handwritten exceptions on the delivery, and signed.
These exceptions may be expressed in writing with the carrier at the moment of delivery, or at the latest 12 hours after the delivery. A copy of such exceptions must be sent by e-mail exclusively to the company SABATIER DIAMANT at the latest 12 hours after these exceptions have been expressed in writing (consumer-service@sabatier.com / service-client@sabatier.com). The customer should, along with this e-mail, have the carrier confirm to SABATIER DIAMANT that such exceptions have genuinely been expressed.
If the products ordered need to be returned to the company SABATIER DIAMANT (non-conformity, damage, etc.), this must occur within seven days worked following the delivery. After this period, no claim will be accepted.
The products must be sent back in their original state (packaging, catalogue, etc.), failing which they may be refused.

It is essential that the customer use the services of the company SABATIER DIAMANT's partner carrier in order to return products. This is because the carrier has contractual links with the company SABATIER DIAMANT which facilitate the various operations linked to international carriage (customs, taxes, payment).
All returns must be accompanied by a copy of the invoice received when the package was received.
The cost for returns shall be borne by the company SABATIER DIAMANT, except in the case of withdrawal (Article 11).
The company SABATIER DIAMANT undertakes to handle all goods returns within 30 worked days of receiving the return.
7 - Risk transfer |
As mentioned in article 4 (4.1), the risks will be transferred under the following conditions:
- - If the customer is bound to pay the costs of carriage and any customs duties or taxes incurred in the country of export, the products shall travel at the risk of the partner carrier, who shall therefore bear liability in the event of a dispute (damage, average, etc.) The sale is made Ex Works THIERS in accordance with the principles of the INCOTERMS 2000
- - If the company SABATIER DIAMANT is bound to pay the costs of carriage and any customs duties or taxes incurred in the country of export, the products shall travel at the risk of the company SABATIER DIAMANT. The sale is made DDP address of package destination in accordance with the principles of the INCOTERMS 2000
- - If the company SABATIER DIAMANT is bound to pay the costs of carriage and the customer must pay any customs duties or taxes incurred in the country of export, the products shall travel at the risk of the company SABATIER DIAMANT. The sale is made DDU address of package destination in accordance with the principles of the INCOTERMS 2000
8 - Liability |
The customer is solely liable for the choice of products ordered, for their maintenance from the moment of delivery and for the use to which they are put. To this end, the company SABATIER DIAMANT reminds customers that its knives and kitchen utensils are designed for culinary use only. Any damage to the products subsequent to their being used in a context other than that of the kitchen (DIY, gardening, etc.) shall not be covered by the manufacturer's guarantee (Article 9).
Similarly, the knives produced by the company SABATIER DIAMANT are designed, within the context of the kitchen, for certain specific usages (see technical files). They are not suitable, for instance, for cutting frozen foods...
The products manufactured by the company SABATIER DIAMANT require specific forms of maintenance (they are not dishwasher proof, for example) and storage (use of blocks or magnetised bars). The "School" section on the website www.sabatier.com provides information on the risks incurred by the customer should he or she fail to observe these basic recommendations.
The inherently hazardous nature of kitchen knives incites the company SABATIER DIAMANT to warn the customer against any ill-advised or not recommended use of such knives, which must at all times be treated as a dangerous cutting implement. Such knives should for example be kept out of the reach of children. Generally speaking, the products distributed by the company SABATIER DIAMANT are aimed at consumers who are responsible adults.
The company SABATIER DIAMANT cannot be held liable for domestic accidents related to the dangerous nature of these products.
9 - Warranty |
The company SABATIER DIAMANT certifies that the hand-wrought knives presented on the website shop.sabatier.com are manufactured in its own workshops, located in France. It guarantees that its knives have been subjected to all the care and verifications necessary to ensure that they comply with the description and the technical data sheet given on the website on the date at which the order is placed.
The manufacturer's warranty provided by the company SABATIER DIAMANT shall apply if and only if the knife or culinary utensil that is damaged has not been used for purposes other than that for which it was designed and has been maintained in the fashion that is appropriate for a product of this standard and nature (Article 8).
If the damage to or failing of the knife or culinary utensil purchased on the website shop.sabatier.com due to faulty manufacture, the manufacturer's warranty applies.

10 - Force majeure |
Neither the company SABATIER DIAMANT, nor the customer of the company SABATIER DIAMANT may be held liable for failure to perform the sale contract thus concluded in the event of the occurrence of a case of force majeure, beyond their control, which shall include, and which list is not exhaustive, war, riots, insurrection, interruption to carriage, import or export problems, strikes, lock-outs, shortages, fire, earthquake, storm or flood.
11 - Right of withdrawal |
In accordance with article L.121-16 of the French Code of Consumption, the consumer has a period of seven working days as from the receipt of the goods ordered in order to return any article with which he or she is unsatisfied and request that it be exchanged, without any penalty, with the exception of the cost of returning the goods.
Any such return must be signified by e-mail at the address customer-service@sabatier.com / service-client@sabatier.com. The number of the order must be given in order for the complaint or claim to be handled.
12 - Protection of personal data |
The company SABATIER DIAMANT undertakes to protect the personal data supplied by its customers. None of the customer's personal data that may be collected by the company SABATIER DIAMANT shall be communicated to any third party. The customer has the right to access, modify, rectify or delete the personal data that related to him or her (Art. 34 of the &lquo; Information Technology and Civil Liberties » Act).
In order to exercise this right, the customer must contact the company SABATIER DIAMANT directly (Art.14)
13 - Nullity – Applicable law – Jurisdiction |
If one of these General Terms and Conditions of Sale should be declared inapplicable or null and void for any reason whatever, this nullity or inapplicability shall not affect the application or the validity of the other provisions of the General Terms and Conditions of Sale.
These General Terms and Conditions of Sale are exclusively governed by French law. The courts of Paris shall have sole jurisdiction for hearing any disputes relative to said Conditions.
